Those who intend to rent a home in Catalan territory will be interested to know that Catalonia has begun the procedures to regulate rentals with the new Housing Law . Below we tell you what has been done in this regard, and above all, what we plan to do.

The Government begins the procedures to regulate rents with the new Housing Law
Patrícia Plaja, spokesperson for the Government , announced Switzerland Email List last Tuesday, June 6, that the Generalitat has gotten to work regulating rents. Specifically, efforts have already begun to delimit the stressed areas of the real estate market . According to the new Housing Law , a reference index that will regulate rental prices will be applied to them.




Plaja has claimed the validity of the price index that the Generalitat prepared in 2019, and which was invalidated when the Executive appealed several articles of the Catalan housing law before the Constitutional Court. The validity of the price regulations will be three years, with the possibility of extending it year by year.

On the other hand, the spokesperson detailed the energy efficiency plan for buildings approved by the Government. The objective is to reduce energy consumption and greenhouse emissions by 16.43%, and save 13.3% in the Generalitat's energy expenditure.

What are the stressed areas that Catalonia is going to regulate with the new Housing Law
Stressed areas are considered to be those in which there is a disproportion between the price of rents or homes and the purchasing power of the neighbors. A municipality may be declared a stressed zone if it meets one of these two requirements:

That the average cost of the mortgage or rent exceeds 30% of the average household income.
That, in the last five years, the purchase or rental price has increased three points above the CPI.
We must not forget that the consideration of a stressed zone is the responsibility of the autonomous communities . Those in which the Popular Party currently governs, such as Andalusia, Galicia or Madrid, have already announced their opposition to the measure.

As you have seen, Catalonia has begun the procedures to regulate rents with the new Housing Law , and perhaps your municipality will be considered a stressed area. Precedents of the new Housing Law: rental regulation in Catalonia
In 2020, Catalonia promoted a Catalan housing law that included a measure of stressed areas and a reference index to measure rental prices there. At the time, the consideration of a stressed area was applied to 61 municipalities .

The Executive appealed the law considering that it invaded powers and the Constitutional Court invalidated it. Now, however, it has the value of being a precedent that tells us how the new Housing Law will be applied in Catalonia.
